Brand Naming and Trademark Selection

WHAT IS NAMING?

What are brand naming and trademark selection?

Brand naming is the work of choosing a name for your business that is both memorable and registrable. Under Article 4 of the Industrial Property Law No. 6769 (SMK), a trademark must be capable of distinguishing your goods or services from those of other businesses. This is why words that directly describe the product, or that everyone in the sector uses, are weak candidates. At Kupon Patent we develop name proposals and run each candidate through a distinctiveness check and a preliminary search.

What do we review in name candidates?

  • Distinctiveness: We check whether the name sets your goods apart from others.
  • Descriptive words: We filter out words indicating kind, quality or purpose.
  • Risk of misleading: We avoid misleading as to nature or origin.
  • Similar marks: We screen records close in spelling, sound and meaning.
  • Class plan: We plan the goods and services classes the name will cover.
  • Digital use: We recommend checking domain names and social media.

How do we proceed?

You choose the name; if you wish, we move on to the application together.

  • Needs analysis: Together we clarify your activity, your target audience and your brand’s personality.
  • Name proposals: Using different approaches, we generate original and memorable brand name candidates.
  • Distinctiveness filter: We assess the candidates against the absolute grounds for refusal in the SMK and eliminate weak ones.
  • Preliminary search: We screen the remaining candidates for similar marks in TÜRKPATENT records.
  • Class plan and presentation: We present the suitable candidates to you with a class plan and risk notes.

Just a creative name, or a protectable one?

A preliminary assessment helps reduce risk; the registration decision is made by TÜRKPATENT.

  • Choosing on taste alone
  • The name is chosen for memorability and personal preference.
  • Descriptive elements or similar records may be noticed only later.
  • Class coverage and digital use are not considered separately.
  • Brand naming with Kupon Patent
  • Candidates are assessed together with distinctiveness criteria.
  • Similar trademark records are screened before filing.
  • A class plan and domain name check are part of the process.

Authorities relevant to choosing a name

In Türkiye, trademark applications are examined by TÜRKPATENT (the Turkish Patent and Trademark Office). If you have goals abroad, we also consider from the outset whether the chosen name fits a protection plan through the WIPO Madrid System or EUIPO.

  • TÜRKPATENT: Türkiye
  • WIPO: Madrid System
  • EUIPO: European Union
